Terms and conditions of service
Welcome to Acuarius Travel. The following Terms and Conditions govern the contracting of tourism services provided by our travel agency and tour operator, based in the city of Arequipa, Peru. By booking or purchasing any of our tour packages, excursions, transfers or complementary services, you expressly and unreservedly accept all the provisions contained in this document.
1. DEFINITIONS
Company or Operator: Acuarius Travel, a formal travel and tourism agency in charge of organizing and/or marketing tourism services.
Customer or Passenger: Natural or legal person who contracts the Company’s services, acting on their own behalf or on behalf of a group of travelers.
2. BOOKING AND PAYMENT PROCESS
2.1 Every booking must be formally requested through our official channels (website, email or WhatsApp).
2.2 To confirm the booking, the Customer must pay the percentage of the total cost indicated at the time of the quote. The remaining balance must be settled before the services begin, according to the deadlines set by our customer service staff.
2.3 Rates are expressed in Peruvian Soles (S/) or US Dollars (US$), as applicable, and include the taxes required by law in force in Peru, unless explicitly stated otherwise.
3. CHANGES AND CANCELLATIONS BY THE CUSTOMER
3.1 Any request by the Customer to change the date, schedule or itinerary is subject to the availability of local providers (hotels, transport, tourist entrance tickets) and may incur additional charges.
3.2 Cancellation and refund policies vary according to how far in advance the request is made and the type of service:
- Cancellations more than 15 days in advance: Subject to a minimum administrative penalty.
- Cancellations between 14 and 7 days before the trip: A penalty equal to 50 percent of the total amount will apply.
- Cancellations less than 7 days in advance or No Show: No refund of any kind will be issued.
3.3 Entrance tickets to specific high-demand attractions (such as certain routes or government reservation tickets) and commercial flights are non-refundable and non-transferable once issued.
4. ITINERARY CHANGES DUE TO UNFORESEEN EVENTS OR FORCE MAJEURE
4.1 In the Arequipa region and surrounding destinations (such as the Colca Canyon, the Sillar Route or volcano ascents), activities are subject to weather and geological factors, strikes, road blockades or decisions by government authorities.
4.2 Acuarius Travel reserves the right to change the order of visits, replace activities or alter the original itinerary for the sole purpose of safeguarding the integrity and safety of passengers.
4.3 In force majeure situations that absolutely prevent the excursion from taking place, the Company will seek to reschedule the activity. If this is not possible, the corresponding refunds will be processed after deducting the operating costs already incurred and unrecoverable from third parties.
5. PASSENGER RESPONSIBILITIES AND OBLIGATIONS
5.1 Documentation: It is the sole responsibility of each traveler to carry valid personal identity documents (national ID, passport or foreigner’s card) in perfect condition.
5.2 Punctuality: The Passenger agrees to strictly respect the schedules set for hotel pick-ups, meeting points and excursion departures. The agency’s transport has limited waiting times due to urban traffic regulations. Extreme lateness will be considered voluntary abandonment of the tour with no right to claim.
5.3 Health and Physical Fitness: The Customer declares that they and their companions are in optimal health to carry out the contracted activities. High-altitude routes such as the Colca Canyon, the Salinas and Aguada Blanca National Reserve or mountain ascents require adequate prior acclimatization. It is the passenger’s duty to report any pre-existing medical condition, allergies or mobility restrictions.
5.4 Conduct: The Company reserves the right to refuse service or remove from an ongoing excursion any passenger whose behavior disturbs order, is offensive to staff or other travelers, or endangers collective safety.
6. LIMITATION OF LIABILITY
6.1 Acuarius Travel acts as an intermediary and direct operator in the provision of tourism services. It is not responsible for material losses, theft, medical incidents, accidents or personal injuries that occur outside the direct control of its team or due to the passenger’s own negligence.
6.2 We strongly recommend that all our customers take out comprehensive travel insurance with health and activity cancellation coverage before starting their routes across southern Peru.
7. JURISDICTION AND CLAIMS
For the resolution of any conflict or disagreement arising from the interpretation or fulfillment of these Terms and Conditions, both parties expressly submit to the laws of the Republic of Peru and to the jurisdiction of the judges and courts of the city of Arequipa, waiving any other jurisdiction that may correspond to them.
